TCPA Update

by Joe Lenski, AAPOR Councilor at Large
On July 10, 2015 the Federal Communications Commission (FCC) released a new order regarding clarification of the Telephone Consumer Protection Act (TCPA) rules and regulations regarding autodialers and cell phones. The new interpretation of the rules have caused much concern among many AAPOR members who currently conduct telephone survey research.

AAPOR has been working closely with our colleagues at CASRO and MRA to provide updated information to AAPOR members. A joint AAPOR/CASRO/MRA webinar entitled Telephone Consumer Protection Act (TCPA): What You Need To Know was held on September 22, 2015 to describe in detail the recent FCC order and its impact and to take questions from AAPOR members about how to deal with the regulations. The webinar panelists included Abby Devine, Director of Government and Public Affairs for CASRO, Peter Milla, a consultant to the global research industry, and Duane Berlin who currently serves as legal counsel to CASRO and AAPOR.

The webinar generated much interest with more than 300 registrants. The webinar recording and presentation slides are available online.

AAPOR Executive Council has appointed a TCPA working group to provide information for AAPOR members and to advise the Executive Council on what steps AAPOR should be taking to protect the interests of AAPOR members regarding the TCPA regulations. The members of the AAPOR TCPA working group are Paul Braun, Mary McDougall, Andy Weiss, Tom Guterbock, Bob Davis, Missy Koppelman, Mary Losch and Jason Boxt. This working group will be coordinating the next steps that AAPOR will be taking to keep its members informed on this important topic.
